Terms and Conditions
Gaura Travel Pty Ltd,”Gaura Travel”, ABN 56 392 778 429 is an Australian company which is engaging the service of Airlines to operate flights from Australia to India.
Those involved in the planning and execution of these repatriation flights are individuals and companies who are working together in these uncertain times, many of whom have put themselves on the line, both mentally and financially, to assist you, “the Passenger”. Therefore, we ask that each Passenger act in an honest and considerate manner.
You, “the Passenger” (meaning each of the passengers in your booking – ie. your travelling party—one family, or a group of friends travelling together etc), acknowledge and agree to be bound by these Terms and Conditions. The group contact person in your booking acknowledges and agrees that he or she has the consents and authorisations of each passenger in the booking group to complete this booking on behalf of each passenger, and therefore that all passengers agree to the terms and conditions laid out in these Terms and Conditions.
The terms and conditions stated in this document (referred to as the “Terms and Conditions”) comprise the entirety of the terms and conditions in connection with this flight. In the event that these Terms and Conditions need to be changed for the operation of this flight, you will receive an updated document containing the new terms and conditions. These Terms and Conditions are governed by the law of Victoria, Australia, and you agree to submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.
To the maximum extent permitted by law, we exclude any and all liability for any losses whatsoever that may arise in connection with this flight, and future intended flights, and by agreeing to these terms and conditions, you, “the Passenger”, hereby release Gaura Travel from any such liability. If a law provides a guarantee or warranty that cannot be excluded, to the extent permitted by law, any liability for a breach of the guarantee or warranty will be limited to either supply of the goods or services again, or payment of the cost of having the same goods and service supplied again, as determined by Gaura Travel.
You, “the Passenger”, acknowledge and agree that this is a private charter operation and not a standard commercial flight, and accept that there may be inherent risks involved with private charter flights that may not exist with standard commercial flight operations. You, “the Passenger”, acknowledge and agree that, particularly given the unprecedented global changes that have resulted from the Covid-19 pandemic, there may be inherent risks for this flight and we are unable to make guarantees in relation to the timing, the actual departure of this flight or the arrival city in India, particularly given the unprecedented global changes that have resulted from the Covid-19 pandemic.
You “the Passenger”, acknowledge that in case of deportation, the entire cost towards deportation penalty, return fare and cost of Quarantine will be borne by You “the Passenger”.
Further, in the event you, “the Passenger”, breach these Terms and Conditions, Gaura Travel will not be liable for any losses whatsoever and you, “the Passenger”, agree to indemnify Gaura Travel for any losses whatsoever that Gaura Travel may suffer as a result of your breach of these Terms and Conditions.
You, “the Passenger”, acknowledge and agree that Gaura Travel has no relationship of employment, trust, agency or partnership with you, “the Passenger”.
If Gaura Travel provides any assistance to you, “the Passenger”, in connection with this flight, such as transport assistance after reaching the arrival airport and information regarding entry into India, you, “the Passenger” will still remain responsible for such matters.
You, “the Passenger”, agree that you are subject to applicable laws in connection with this flight.
Henceforth, the terms “you” and “Passenger(s)” refer to the person making the booking and each of his/her travelling party.
Only the following people will be permitted to book and fly on this flight, and future flights:
An Indian citizen who normally resides in India or, an Overseas Citizen of India (OCI) who normally resides in Australia. OCI holders needs to get Travel Permit leave Australia. It is the responsibility of you “the Passenger” to arrange this travel permit from Australian Government.

A person who is NOT exhibiting ANY of the following symptom(s)—cough, sneezing, fever or any respiratory distress. If you have any of these symptoms you will likely be denied boarding of the flight by Government officials at the airport.
A person who satisfies points 1 and 2 above, and who is very confident that s/he will be able to arrive at the departure airport in plenty of time for the flight (at least 5 hours prior to the scheduled departure time).
It is the sole responsibility of the passenger to ensure his / her eligibility to enter the destination country. Gaura Travel accepts no liability in this regard.
No refund will be provided to You “the Passenger” if for any reason you are not able to board the aircraft.

For all incoming flights into India from foreign stations, list of passengers traveling on each flight will be finalized by Indian Mission in the country of origin.
This repatriation flight, and other intended flights, will be operated by full serviced Airlines using Airbus 330/359(2 class) planes, with certified Air crews. Gaura Travel will coordinate the flights and ticketing.
The money You “the Passenger” pays for a ticket will fund the plane, the crew, food, airport fees, etc.
The entire cost of travel will be borne by You “the Passenger”.
Gaura Travel are charging people for travel on Economy and Business Class seats. Price is outlined in the shopping cart..
Gaura Travel are charging people 10% of the ticket price(mentioned above) for Infants
These charter flights are meant for repatriation services during COVID-19. Airlines offerings and services are limited during these repatriation flights. Many features / services provided during normal times might not be available for this charter flight which is meant for repatriation. This is applicable for all Business and Economy class travellers who have purchased a seat in the charter for repatriation purpose.
Gaura Travel reserves the right to vary ticket price at any time without notice and this will not lead to the grounds for any partial/full refund or any compensation to the passengers who already bought the tickets before the price is varied Every effort will be made to ensure that flights will not be overbooked.
Ticket Payment and Issuing Tickets
Ticket booking will be done through an online portal. This online portal only accepts Visa, Mastercard and American Express credit cards. The money will be collected into an account held by Gaura Travel Pty Ltd.
At the time of booking 5% of total booking value would be deducted as deposit. Once the passport details are validated by Governmement of India, we will notify you to make the balance payment. Balance payment needs to be made within 24 hours after notification through EFT.
E-tickets will only be issued once EFT amount appears in the Gaura Travel bank account has cleared funds.
For each booking, Airlines will issue an electronic ticket. The electronic ticket will be emailed approximately 24 to 48 hours prior to flight departure to the email address in the booking. This ticket must be presented at the departure airport.
You should regularly check the email address that you provided in your booking (including any spam/junk folders) for information in connection with this flight.
Information relating to ticket purchases will be made available to the Indian High Commission in real-time. Passenger list on the flight will not be provided to You “the Passenger”
Restrictions on Ticket Purchase
As there is a limited number of seats available on each flight, you, “the Passenger”, agree to only purchase seats for individuals within your immediate travelling party (e.g. family, group of friends), and who will be ready and able to board the flight in question, including being able to reach the departure airport on time and having the necessary documents to enter India. Please also see the ‘Eligibility’ section above.
There is a limit of 8 tickets per individual booking. Please respect this, as there are many people wishing to get home to Australia at present.
Tickets are not transferable from one passenger (whose name is on the ticket) to another passenger.
Refer to product description box at the time of purchase. Each PAYING passenger will be allowed their mentioned baggage and one (1) piece of carry on luggage, weighing a maximum of 7kg . This allowance will be STRICTLY enforced at the airport and there will be no ability to purchase an additional luggage allowance.
Each INFANT under 2 years will be allowed a maximum of one (1) piece of carry on luggage weighing a maximum of 5kg. In addition, one (1) pram will be allowed per travelling infant.
You must not include in your luggage any items that are prohibited by any relevant law from being carried onto a plane. You must carry all fragile or valuable items in your carry on luggage.
Infants under 2 years will require a separate ticket and will be seating with the accompanied adult. No sperate seat is provided to the infant. When completing your booking, infant passenger information is required and a valid passport, or visa and permission to travel, for infants is still mandatory, including in the case where a child has been born in India to Australian parents. It is a requirement of the Flight that there is a minimum of one travelling adult for each travelling infant under 2 years. Bassinet will not be available for these repatriation charter flights.
Given the unprecedented global changes that have resulted from the Covid-19 pandemic, infants under 4 weeks are not permitted on this flight without written authorisation from Gaura Travel prior to booking, with such written authorisation to be at Gaura Travel’s sole discretion.
Children Under 18 Years
Given the unprecedented global changes that have resulted from the Covid-19 pandemic, children under 18 years must be accompanied on the flight by their parent or guardian.
Given the unprecedented global changes that have resulted from the Covid-19 pandemic, pregnant women who are more than 28 weeks pregnant are not permitted on this flight unless they satisfy the flying requirements of Airlines.
You, “the Passenger”, acknowledge and agree that this flight may not contain certain services and amenities normally provided by standard commercial airlines. However, every effort will be made to provide you with the necessary amenities (i.e drinking water, food, etc). The plane used in this flight is equipped with onboard safety equipment. Disinfection procedures for the plane will be followed prior to boarding and the flight crew will wear personal protection equipment.
Superior seats, where available, and priority check-in and boarding will be provided to the elderly, pregnant women, families with young children, individuals with a disability and those who would be at risk of severe symptoms of Covid-19 if they happened to contract the disease. It is expected that Passengers help to prioritise these individuals.
Inflight interactions between crew and passengers will be kept to a minimum with no catering services. However, food packs and bottled water will be pre-placed on the seats instead.
Some seats are blocked off for compliance with local regulations, crew rest and quarantine area on board.
India requires passengers be supplied with personal protective equipment (PPEs) if the middle seat is not kept empty.
You and your luggage may be subject to inspection and disinfection procedures.
You, “the Passenger”, agree to follow any and all specific directions given to you by the ground staff, flight crew and officials at the departure and arrival airports and during the flight.
We reserve all rights to refuse the boarding of any Passenger or remove any Passenger from the flight, without any liability for losses whatsoever, if Gaura Travel consider it is in the best interests of the flight’s operation and the other Passengers and flight crew.
At the departure and arrival airports and during the flight You “the Passenger” are strongly encouraged to wear your face mask over your mouth and nose and practice 1.5 metre social distancing to the maximum extent possible.
Visas and Immigration
You “the Passenger” is taking responsibility that you are fully eligible to enter or transit the country for which you are purchasing a ticket on these special charter flights .Gaura Travel accepts no liability in this regard.
Arriving into India
In making this booking You “the Passenger” acknowledge and agree that you are eligible to enter India under the current border arrangements, and that you have the correct and necessary documents for entry. We are unable to give you any advice in relation to your eligibility to enter India and any information provided in these Terms and Conditions has not been verified by an Australian and Indian government official and is provided to the best of Gaura Travels knowledge and belief.
If you are holding an Australian passport or Permanent Resident then you will have get permission to leave Australia from Department of Home Affairs.
As per the above, You “the Passenger” should apply for a travel permit and permission to leave Australia BEFORE booking your ticket. Gaura Travel accepts no liability in this regard.
If you have any doubts about whether you have the correct status or permissions, prior to making a booking for this flight please contact the Indian High Commission in Australia and Department of Home Affairs, Australia.
Prior to booking a ticket, all passengers must carefully consider the information in the ‘Eligibility’ and the ‘Visa and Immigration’ sections of these Terms and Conditions in order to ascertain whether you are indeed eligible to leave Australia and enter India at this time. If you are ineligible to leave Australia or enter India at this time, and still purchase a ticket, you will not be allowed to board the flight and the cost of your ticket will not be refunded under any circumstances.
Gaura Travel’s Terms and Conditions on Booking, Ticket Changes and Ticket Cancellations/Refunds
To assist with a smooth passage through both Australian and Indian customs it is critical that you provide the correct information on the booking form. Names (surname and given names) must match those provided on your passport. If a name field in your passport is blank please write “N/A”. If you are an Indian Visa / OCI holder you must ensure that the visa type and number are provided.
This and all other information you provide on the booking form (for example, address for stay in India) must be up-to-date and valid. Failure to comply may result in the cancellation of your booking, delays transiting through Australia or denial of entry to India upon arrival.
It is your responsibility to provide all details on the booking form correctly and Gaura Travel Pty Ltd will not be liable for any losses whatsoever that may occur due to incorrect information being supplied for passengers.
It is the responsibility of You ”the Passenger” to ensure that transportation to their departure point is available before booking a flight. Cancellation or flight change requests based on transportation unavailability will still result in the application of the applicable policy.
Any cancellations or no-shows by a ticket holder, for any reason, will result in the loss of all payments. This includes the situation where a ticket-holder(s) cannot board a flight due to reasons beyond their control, such as being delayed in reaching the airport or being denied boarding for whatever reason.
Our liability to You “the Passenger” is limited to refund the ticket price if the charter flight does not operate on or around the scheduled date due to reasons within our control. Gaura Travel will not be liable for any other claim including the negligence or fault, if any, of ours or of a third party.
In relation to the Flight, date of departure or arrival, the city of departure or the city of arrival, can change for reasons beyond our control and if it happens this will not be the grounds for seeking refund.
No refund would be permitted based on such changes.
Gaura Travels’s Change Policy
AUD 250.00 change fee will be applied for each change request made after the submission of your booking.
Requests for flight transfers after a flight has closed will not be allowed.
PASSENGERS WITH MEDICAL CONDITIONS
The Airlines will ask You “the passenger” to declare any serious medical conditions at the time of booking and will reserve the right to refuse ticket issuance if your health cannot be appropriately managed on this flight.
You, “the Passenger”, acknowledge that you will be required to observe a quarantine period in the city of arrival in India.
You will be responsible for making your own travel arrangements to your home after the quarantine period has ended, and for the costs of these arrangements.

Passengers have to undertake to directly bear the entire cost towards Quarantine charges at the time of arrival at the destination.
We “Gaura Travel” ask you to remember that we have thousands of people who wish to return to India. Under the current circumstances, there are going to be people who may not be able to make one of charter flights for dozens of different reasons despite having purchased a ticket. We have limited human resources and time, and do not have sophisticated booking systems or sophisticated processes in place to handle queries and complaints. Our objective is to get as many stranded Indians home to India from Australia as quickly as possible.
